LEASE AND RELEASE

This Indenture made the twenty Sixth day of December in the year of our Lord Christ one thousand Seven hundred and Eighty Seven and Twelfth year of American Independence Between John PURSSELL in the State of South Carolina and County of Edgefield of the one part and Aaron HERRIN in the State and County aforesaid of the other Part 

Witnesseth that for Said John PURSELL for and in consideration of the sum of five Shillings Sterling Money to him in hand well and Truly Paid by the said Aaron HERRIN at and before the Sealing and Delivery of these Presents the Receipt Whereof is hereby acknowledged have Bargained and Sold and by these Presents Do bargain and Sell unto the said Aaron HERREN in his actual Possession now being by Virtue of a bargain and Sale to him thereof made and to his heirs and assigns all That Plantation or Tract of Land Containing Seventy acres Situate Lying and being in Edgefield County aforesaid.

Bounded Beginning at a Corner Hickory on David MELONES old line S.W. to a Corner Pine on TUTTS old line S.E. to a Dogwood N.E. to a Gum N.W. to a Stake S.W. to the place of Beginning. Together with all and Singular the Rights, Members, Previledges Hereditaments and appurtenances Whatsoever to the Said Tract of Land as herein before mentioned and Premises hereby Intended to be Bargained and Sold with their and Every of their Rights Members and Appurtenances unto the said Aaron HERRIN his heirs and assigns from the Day next after the Day of the Date of these Presents for and During and untill the full End and Term of one Whole year from thence next Ensuing and fully to be Compleated and Ended Yielding and Paying therefore unto the said John PUSELL his heirs &.e. the Rent of one Barley Corn at the Expiration of the said Term if the same be Lawfully Demanded to Intent and purpose that by Virtue of these Presents and by force of the Statute for Transferring of uses into Possession the said Aaron HERREN and be in the actual Possession of all the Said Premises and be thereby Enabled to take and Except a grant and Release of the Reversion and Inheritance thereof to his heirs and assigns forever and for no other use Intent or Purpose Whatsoever

This Indenture made this Twenty Seventh Day of December in the year of our Lord Christ one Thousand Seven hundred and Eighty Seven and Twelfth year of American Independence.

Between John PURSSELL in the State of South Carolina and County of Edgefield of the one part and Aaron HERRIN of the State and County Aforesaid of the other part.

Witnesseth that the said John PURSSELL for and in Consideration of the Sum of Seventy six Pounds Sterling Money to him in hand well and Truly paid by the said Aaron HERRIN at and before the Sealing and Delivery of these Presents the Receipt Whereof is hereby acknowledged Have Granted Bargained Aliened Remised Released Conveyed and Confirmed unto the said Aaron HERRIN in his Actual Possession

Now being by Virtue of a Bargain and Sale to him thereof made by the said John PURSSELL by Indenture of Lease bearing Date the day next before the Day of the date of these Presents and by force of the Statute for Transferring of uses into Possession and To his heirs and Assigns forever all that Plantation or Tract of Land Lying and being Situate on Waters of Stephens Creek in the County of Edgefield in the State of South Carolina Containing Seventy Acres Butting and Bounding Begining at a Corner Hickory on David MELONES old Line S.W. to a Corner pine on TUTTS old line S.E. to Dogwood N.E. to Gum N.W. to Stake S.W. to the Beginning. Together with all all and Singular the Hereditaments Rights Members and Appurtenances Whatsoever to the said Plantation or Tract of Land belonging or in any wise Appertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and also all the Estate Rights Title Interest Inheritance Benefit and Claim of him the said John PURSELL which said Plantation or Tract of Land Containing Seventy acres as aforesaid Being part of a Tract Granted to John MORIS and Conveyed by said John MORIS to said John PURSELL and Conveyed by said John PURSELL to Aaron HERRIN With the Appurtenances and every Part and Parcel thereof.

To have and To hold the said Plantation or Tract of Land and all and Singular the Premises and Appurtenances herein before mentioned or meant or Intended to be granted and Released unto the Said Aaron HERRIN his heirs and assigns forever unto his or their only Proper use Benefit and Behoof and the said Plantation or Tract of Seventy Acres of Land With Every of the Premises and Appurtenances before mentioned unto the said Aron HERRIN his heirs and assigns the said John PURSELL from himself his heirs Executors administrators and Asigns and from Every Other Person or Persons Whatsoever Shall and Will Warrant and forever Defend free and Clear from all manner of Incumbrance Whatsoever

Be it known That on the Thirty first Day of March 1795 that John SULLIVAN came before me Richard TUTT one of the Justices of the Peace for the Said County, and after being Duly Sworn on his oath Saith that he Did See John PURSSELL & Barbary PURSSELL make their marks to the Instrument of Writing for the uses and purposes therein Mentioned and also Saw them Sign a Lease for one year & acknowledge the same at their act and Deed and Likewise Saw the Said John PURSSELL & Barbary PURSSELL Sign the Receipt hereon Indorsed and that he this Deponant With Elijah LYON & Absolam ROBERTS Sign their names as Witnesses thereto Sworn to the Day and year first above Written before me
