John PRESLEY to John KIRKSEY Deed - State of South Carolina

Know all men by these presents that I, John PRESLEY of Edgefield District, in the State aforesaid, in consideration of the sum of four hundred and forty five dollars, to me paid by John KIRKSEY, of the state and district aforesaid, have granted, bargained, Sold, and released, and by these presents do grant, bargain, Sell, and release, unto the said John KIRKSEY, all that tract of land situated on Log Creek, waters of Savanah River containing fourty four and a half acres and has such shapes, and boundaries, as are fully represented by a plat, thereof (drawn) by Wm. BRUNSON, Deputy Surveyor and dated May 4th, 1836.  Bounded North East by lands of W. SIMKINS, from which is separated by a branch of Log Creek, South by Charlotte BRAZIER's land, and John KIRKSEY's, adjoining the village of Pottersville, and west by John KIRKSEY and Dr. Abner LANDRUM land from which it is separated by the same road, from Edgefield Village to Cambridge.  Together with all and singular, the rights, members, hereditaments, and appurtenances, to the said premises belonging, or in any wise incident, or appurtaining, to have and to hold all and Singular, the premises before mentioned unto the said John KIRKSEY, his heirs, and assigns forever.  And I do hereby bind myself, my heirs, Executors, and administrators, to warrant, and forever defend, all and singular the said premises, to the said John KIRKSEY, his heirs and assigns, against myself and my heirs and against every person whomsoever lawfully claiming, or to claim the same or any part thereof these premises to be delivered the first of January 1837.  Witness my hand and seal this 6th of May in the year of our Lord 1836.   John (his "P" mark) PRESLEY (JS? in seal)

Personally came Washington BROOKS before me and made oath that he saw John PRESLEY Sign, and deliver the within instrument of writing for the uses and purposes therein mentioned and that Ervin P. KIRKSEY was present and signed with this deponent, as witness to the same.  Sworn to before me July the 16th, 1836.

I, William BRUNSON of the Justices of the Qourum for the district aforesaid, do hereby certify unto all whom it may concern that Margaret PRESLEY, the wife of the within named John PRESLEY did this day appear before me and upon being privately and Separately examined by me did declare that she does freely voluntarily and without any compulsion, dread, or fear of any person or persons whomsoever renounce, release and forever relinquish unto the within named John KIRKSEY all her right, title, interest, and claim and also all her right and claim of dower of in and to all and singular the premises within mentioned and released.  Given under my hand and seal this 28th of October 1886.                                                                                                                                                                      Margaret (her mark) PRESLEY

I do hereby acknowledge the receipt of one hundred dollars, from John KIRKSEY to me in hand paid for a house in the village of Pottersville known as Dr. Abner Landrum's office, and the lands upon which the said house stands, the right and title to which I do bind myself, my heirs, Executors, and administrators, to defend unto the said John KIRKSEY his heirs and assigns forever.  Witness my hand and seal this May 6th, 1836
