This Indenture made this 24th day of October 1898
between Ermon J. Maddux, Mary H. Presley and Wm. R. Presley, Ella S. Maddux,
James S. Maddux & Julia A. Maddux of Shelby County Tennessee and Sarah E.
Presley & James A. Presley of the County of Tate and State of Mississippi
of the one part and James A. Presley of the county of Tate and State of
Mississippi of the other part.
Witnesseth that said Grantors parties of the first part for and in
consideration of Twelve Hundred ($1200.00) Dollars to them in hand paid by
James A. Presley the receipt whereof is hereby acknowledged hereby sells and
conveys unto the said James A. Presley heirs and assigns forever a certain
tract of land situated and being in the county of Tate State of Mississippi to
wit the 160 unsold acres of ½ Section 29 Township 4 North of Range 8 West
conveyed to the late C. A. Maddux by Deed registered on Book 6 page 127 of the
Records of deeds in the office of the Chancery Clerk of the Chancery Court of
Tate County Mississippi, said unsold portion being the 160 acres of the West
half after deducting the 75 acres heretofore sold to John Moore and the 85
acres heretofore sold to Wood Anderson, by the parties of the first part.
To have and to hold the aforesaid land with all and singular
the hereditaments and appertenances of and to the same belonging, or in any
wise appertaining to the said James A. Presley his heirs and assigns forever,
and the said parties of the first part for their heirs and representations do covenant
and agree to and with said James A. Presley his heirs or assigns, that they
lawfully seized in fee of the aforegranted premises; that the same are free
from all incumbrance, that they have a good right to sell and convey the same to
James A. Presley as aforesaid; and that the before granted land and premises
they will warrant and forever defend against all lawful claims whatsoever.
In witness whereof the said parties of the first part have
hereunto set their hands and affixed their seals the day and year above
written.

Personally appeared before me R. J. Black a Notary Public in and for said State and County of Memphis duly Commissioned and qualified Ermon J. Maddux, Mary H. Presley, W. R. Presley, Ella S. Maddux, James S. Maddux and Julia A. Maddux the within named bargainers with whom I am personally acquainted and who acknowledged that they executed the within instrument for the purposes therein contained and Mrs. Mary H. Presley wife of said W. R. Presley having appeared before me privately and apart from her Husband the said Mary H. Presley Acknowledged the Execution of the said instrument to have been done by her freely, Voluntarily and understandingly without compulsion or constraint from her said husband and for the purposes therein expressed.
