Thos. PRESLEY to Allen Y. BURTON MORTGAGE – South Carolina, Edgefield District
Whereas I Thomas PRESLEY of the State and District aforesaid, have made and executed my promissory note, bearing even date with these presents, payable to Allen Y. BURTON for the sum of one hundred and twenty dollars, and is due and payable on the twenty fifth day of December next. Now therefore Know all men by these presents that I Thomas PRESLEY in order the better to secure the payment of the said sum of one hundred and twenty dollars to the said Allen Y. BURTON, and in Consideration of the sum of five dollars to me in hand paid by the said Allen Y. BURTON at and before the Sealing and delivery of these presents do Grant, bargain, sell and release unto the said Allen Y. BURTON all that lot or parcel of land situate in the Village of Pottersville adjoining lots of Joseph PHILIPS and Abner LANDRUM, Containing according to admeasurement one acre and twenty one polls, and this day conveyed by the said Allen Y. BURTON to me the said Thomas PRESLEY, Together with all and singular the rights, members, hereditaments and appurtenances to the said premises belonging or in any wise incident or appertaining. To Have and To Hold, all and singular the premises above mentioned unto the said Allen BURTON his heirs and assigns forever. Provided nevertheless and it is the nul, intent and meaning of these presents, that if the said Thomas PRESLEY, his heirs executors or administrators, shall well and truly pay or satisfy the said Allyn Y. BURTON his heirs, executors, administrators or assigns the said sum of money above mentioned, without delay or defalcation according to the tenor and effect of the note above recited, then this deed, and all and every clause and article thereof shall cease, determine and be of no effect, otherwise to remain in full force and virtue. In Testimony where of I have here unto set my hand and seal this fifteenth day of January in the year of our Lord one thousand eight hundred and thirty, and in the fifty fourth year of the Sovereignty and Independence of the United States of America.
