GUION MILLER ROLL - EASTERN CHEROKEE

INTRODUCTION

In 1902 the Cherokee Nation filed suit against the United States Government concerning grievances arising out of treaties.  These suits were (1) The Cherokee Nation v. The United States, General-Jurisdiction Case No. Z3199; (2) The Eastern and Emigrant Cherokees v. the United States, General-Jurisdiction case No.23212; and (3) The Eastern Cherokees v. The United States, General-Jurisdiction Case No. 23214. May 18, 1905, the court decided in favor of the Eastern Cherokees and more than $1 million was appropriated by Congress for use in payment of these claims. Guion Miller was appointed as a Special commissioner of the Court of Claims. Eastern and Western Cherokee Indians who at the time of the treaties of 1835-36 and 1845 who were alive on May 28, 1906, who could establish the fact that at that time they were members of the Eastern Cherokee Tribe or were descendants of such persons, and that they had not been affiliated with any tribe of Indians other than the Eastern Cherokees or the Cherokee Nation, should have on file or should file applications with the commissioner of the Court of Claims to share in this settlement. 45,878 applications were filed representing about 90,000 individuals. Most could not prove they were descendants of this Alexander Brown. There are several hundred persons who have filed applications…..who for the most part live in the extreme southern section of Alabama and the western section of Florida, who are not Cherokees, but Creek. Quite a number of these claim descent from such historic Creek characters as Billy Weatherford, Peggy Bailey, William and Chilly McIntosh and Alexander McGillivray, and most of these applicants claim only through the Hollinger, McGhee, McIntosh, Moniac, McGillivray, Franklin or Killiam families, which are all Creek origin. Some of these are recognized as members of the Creek tribe; others, while not recognized as members, claim as descendants of some Creek ancestor.
